Appeals

Our lawyers handle commercial and business matter appeals to the various Departments of the Appellate Divisions and the Appellate Term of the Supreme Court in New York. Simply put, an appeal arises when a client has either lost or won at the trial court level and needs representation to reverse or affirm the trial court’s decision.

Civil appeals can arise in numerous legal contexts, including breach of contract, fraud, or employment matters, to name a few. In some cases, an appeal may be filed before a final order or decision is issued—this is known as an interlocutory appeal. While the case may still be ongoing, resolving an interlocutory appeal can be critical to the outcome for either party.

Appeals may result from a motion to dismiss or a motion for summary judgment. These motions can dispose of a case early—either at the pleading stage or after discovery but before trial. An appeal may be necessary if a party believes their case was prematurely dismissed. However, due to the costs involved, it’s important to carefully evaluate whether pursuing an appeal is worthwhile.
